Quick Summary of NDIS Rules

There are certain rules set out by NDIS (Quality and Safeguards Commission), which directly affect providers. It is merely important to go through these once you have made up your mind to go for it.

Are these rules specifically for provider only?

The set of rules is a balanced approach to ensure that it covers rights and safety management of provider together with its workers and participants.

These rules are briefly described as follows;  

NDIS Code of Conduct and Guidelines – applies to all NDIS providers and their workers.

Incident Management and Reportable Incidents – Requires NDIS providers to manage certain incidents that happen in connection with providing support or services to people with disability.

Complaints Management & Resolution – Requires NDIS providers to manage complaints and maintain records of these complaints.

Worker Screening – Requires NDIS providers to engage/employ workers only when they have obtained an NDIS Worker Screening Check clearance.

Behaviour Support and Restrictive Practices – Outlines reporting and oversight to ensure compliance with state and territory authorisation arrangements and reduce/eliminate the use of restrictive practices in the NDIS

Provider Registration and NDIS Practice Standards, Quality Indicators – Outlines requirements for providers and key personnel to get registered and provides publication of an NDIS Register to include provider’s registration details and relevant compliance action. Also, it sets out the criteria by which NDIS providers will have to demonstrate compliance with the NDIS Practice Standards.

Protection and Disclosure of Information – Prescribes guidance and rules in relation to the NDIS Commissioner’s disclosure powers

Technical Rules – Sets out the conditions of registration for NDIS providers of Specialist Disability Accommodation (SDA)

Transitional Rules for existing registered providers to transition as registered NDIS providers into the NDIS Commission by modifying certain provisions of the Act.
